Terms of service

These Terms of Service ("Terms") govern your use of palladiumboots.co.za (the "Site") and every purchase made through it. The Site is operated by Partisan Trading, trading as Palladium South Africa ("we", "us"), the authorised distributor of Palladium footwear in South Africa, of 25 4th Avenue, Parkhurst, Johannesburg, 2193. By using the Site or placing an order you agree to these Terms.

1. Who may order

You must be 18 or older, or have the consent of a parent or guardian, to place an order. You warrant that the information you give us is accurate and that you are authorised to use the payment method you select.

2. Products, prices and availability

All prices are in South African Rand and include VAT at the applicable rate. Delivery fees are shown separately at checkout before you pay. We take care to display colours and details accurately, but screens differ and slight variations between the photograph and the product are not defects. Stock shown on the Site is updated from our warehouse system during the day; if an item you ordered is unavailable we will tell you as soon as we know and refund that item in full.

3. Orders and contract

Placing an order is an offer to buy. An order is accepted, and a contract formed, when we send you the order confirmation email. We may decline or cancel an order where there is an obvious pricing or stock error, where we suspect fraud, or where the delivery address is outside the areas we serve; in every such case any payment you have made is refunded in full.

4. Payment

We accept the payment methods shown at checkout, which currently include card payments through PayFast, instant EFT through Stitch, and buy-now-pay-later through Payflex, PayJustNow and Float. Payments are processed by those providers under their own terms; we do not store your card details.

5. Delivery

Delivery options, costs and estimated times are set out in our Shipping Policy, which forms part of these Terms. Risk in the goods passes to you on delivery to the address you gave us, or on collection from our Parkhurst store.

6. Cooling-off, returns and exchanges

Because you buy online, section 44 of the Electronic Communications and Transactions Act gives you the right to cancel an order without reason within 7 days of receiving it; we go further and allow 14 days as set out in our Refund & Exchange Policy, which forms part of these Terms. Goods must be unworn, in their original packaging and in a resaleable condition. Nothing in these Terms limits your rights under the Consumer Protection Act, including the six-month implied warranty on defective goods in section 56.

7. Intellectual property

Palladium, the Palladium "P" and aeroplane logos and all product names are trademarks of their owners and are used by us under licence. The content of the Site – text, photographs, graphics and code – belongs to us or our licensors. You may browse and share links, but you may not copy, reproduce or use the content commercially without our written permission.

8. Promotions and discount codes

Discount codes are valid for the period and conditions stated when issued, cannot be exchanged for cash, and may be withdrawn if misused. Only one code can be applied per order unless we say otherwise. Sale items are final-price items but still carry your statutory rights on defects.

9. Liability

To the extent the law allows, our liability to you for any claim arising from the Site or a purchase is limited to the price you paid for the goods concerned. We are not liable for indirect or consequential loss. Nothing in these Terms excludes liability that cannot be excluded under South African law, including under the Consumer Protection Act.

10. Privacy

We process your personal information in line with the Protection of Personal Information Act and our Privacy Policy, which you can read on the Site.

11. Disputes and law

These Terms are governed by South African law. If you have a complaint, email palladium@partisanandco.com and we will aim to resolve it within 7 working days. You may also refer a dispute to the Consumer Goods and Services Ombud or the National Consumer Commission.

12. Changes

We may update these Terms from time to time; the version on the Site when you place an order is the one that applies to that order.
